End-User License Agreement (EULA)

End-User License Agreement (EULA) for World Battlefest – Global Supremacy.

This End-User License Agreement (“EULA”) is a legal agreement between you and
Curiositywave Gaming (“Licensor”).

This EULA agreement governs your acquisition and use of our World Battlefest: Global
Supremacy software (“Software” or “Game”) directly from Curiositywave Gaming or indirectly
through a Curiositywave Gaming authorized reseller or distributor or distribution platform (a
“Reseller”).

Please read this EULA agreement carefully before completing the installation process and using
the World Battlefest: Global Supremacy software. It provides a license to use the World
Battlefest: Global Supremacy software and contains warranty information and liability
disclaimers.

This EULA agreement should be read in conjunction with our Gaming Privacy Policy and
Gaming Terms of Service both which are located on our website www.gaming.curiositywave.com at the
following addresses:

If you register for a free trial of the World Battlefest: Global Supremacy software, this EULA
agreement will also govern that trial. By clicking “accept” or installing and/or using the World
Battlefest: Global Supremacy software, you are confirming your acceptance of the Software and
agreeing to become bound by the terms of this EULA agreement.

If you are entering into this EULA agreement on behalf of a company or other legal entity, you
represent that you have the authority to bind such entity and its affiliates to these terms and
conditions. If you do not have such authority or if you do not agree with the terms and conditions
of this EULA agreement, do not install or use the Software, and you must not accept this EULA
agreement.

This EULA agreement shall apply only to the Software supplied by Curiositywave Gaming
herewith regardless of whether other software is referred to or described herein. The terms also
apply to any Curiositywave Gaming updates, supplements, Internet-based services, and support
services for the Software, unless other terms accompany those items on delivery. If so, those
terms apply.

Terms and Termination

This EULA agreement is effective from the date you first use the Software and shall continue
until terminated. You may terminate it at any time upon notice to Curiositywave Gaming.

It will also terminate immediately if you fail to comply with any term of this EULA agreement.
Upon such termination, the licenses granted by this EULA agreement will immediately terminate
and you agree to stop all access and use of the Software. The provisions that by their nature
continue and survive will survive any termination of this EULA agreement.

License Grant

Curiositywave Gaming hereby grants you a personal, non-transferable, non-exclusive,
world-wide license to use the World Battlefest: Global Supremacy software on your devices in
accordance with the terms of this EULA agreement.

You are permitted to load the World Battlefest: Global Supremacy software (for example a PC,
laptop, mobile or tablet) under your control. You are responsible for ensuring your device meets
the minimum requirements of the World Battlefest: Global Supremacy software.
You may permit your family members and your friend’s access to use and play your installation
of the Game on permitted hardware devices under your control, with the understanding you will
not provide or permit access to the Game to any other persons.
You are not permitted to:

  • Edit, alter, modify, adapt, translate or otherwise change the whole or any part of the
    Software nor permits the whole or any part of the Software to be combined with or
    become incorporated in any other software, nor decompile, disassemble or reverse
    engineer the Software or attempt to do any such things
  • Reproduce, copy, distribute, resell or otherwise use the Software for any commercial
    purpose
  • Allow any third party to use the Software on behalf of or for the benefit of any third party
  • Use the Software in any way which breaches any applicable local, national or
    international law
  • use the Software for any purpose that Curiositywave Gaming considers is a breach of
    this EULA agreement

Intellectual Property and Ownership

Curiositywave Gaming shall at all times retain ownership of the Software as originally
downloaded by you and all subsequent downloads of the Software by you. The Software (and
the copyright, and other intellectual property rights of whatever nature in the Software, including
any modifications made thereto) are and shall remain the property of Curiositywave Gaming.
Curiositywave Gaming reserves the right to grant licenses to use the Software to third parties.

Distribution Platforms

In addition to this EULA, the Distribution Platform Terms and Conditions may affect the rights,
obligations, and liabilities of you in relation to the Game. You acknowledge the Distribution
Platform has rights under the Distribution Platform Terms and Conditions and the Licensor will
not be in breach of this EULA as a result of, and will not be liable to you in respect of:

  • any act or omission of the operator,
  • any loss or damage arising out of the operator’s exercise of its right under the
    Distribution Platform Terms and Conditions

In the event of conflict between this EULA and the Distribution Platform Terms of Conditions,
the provisions of the latter shall take precedence.

To provide upfront clarity, while not an all-inclusive listing, the following matters shall be
governed by the provisions of the Distribution Platform Terms and Conditions:

  • the amounts payable by you in respect of this EULA,
  • the method of payment to be used by you,
  • any rights you have to cancel this EULA and receive refunds of amount paid in respect
    of this EULA

Warranties and Liability

Use of the Game is at your own risk and is provided “as is” and “as available” without warranty
or representation of any kind. The Licensor disclaims all warranties, representations and
conditions of any kind relating to its content in the Game, including without limitation any implied
warranties of satisfactory quality, merchantability, fitness for purpose or non-infringement of third
party rights. In addition, the Licensor does not warrant or represent that your use of the Game
will be uninterrupted or secure or free from bugs or errors.

IN NO EVENT WILL THE LICENSOR CURIOSITYWAVE GAMING BE LIABLE TO YOU FOR ANY LOSS OF PROFITS, CHARGES OR EXPENSES, LOSS OF DATA OR ANY CORRUPTION OR LOSS OF INFORMATION, OR ANY LOSS OF,BUSINESS OPPORTUNITY, OR ANY SPECIAL, INDIRECT, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL LOSS OR DAMAGE OR DISRUPTION OF ANY KIND, IN ANY CASE, WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE OR BREACH OF STATUTORY DUTY), MISREPRESENTATION, RESTITUTION OR OTHERWISE WHETHER OR NOT THE RELEVANT PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. THE FOREGOING LIMITATIONS WILL SURVIVE AND APPLY EVEN IF ANY LIMITED REMEDY SPECIFIED IN THIS USER AGREEMENT IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

Nothing in this User Agreement purports to limit or exclude either party’s liability: (i) for fraud,
fraudulent misrepresentation or willful misconduct; (ii) for death or personal injury caused by that
party’s negligence: or (iii) to the extent otherwise not permitted by applicable law.

Governing Law

This EULA agreement, and any dispute arising out of or in connection with this EULA
agreement, shall be governed by and construed in accordance with United States (US) laws,
and in accordance with US Federal law, where applicable.
